License Agreement

Panda Merge

1. Definitions

  • "Game" refers to Panda Merge (package: com.sensei.pandamerge), including all associated assets, code and content.
  • "Licensor" refers to Sensei Studios, the developer and publisher of the Game.
  • "User" or "You" refers to any individual who downloads, installs or uses the Game.

2. Grant of License

Subject to the terms of this Agreement, the Licensor grants You a limited, non-exclusive, non-transferable, revocable license to download, install and use the Game on compatible devices for personal entertainment. You must be 18 or older (or the age of majority where you live) to use the Game.

3. Open Source Code

  • The Game's source code is published under the MIT License. Your rights to the source code come from that license, and nothing in this Agreement limits them.
  • The music and sound effects are made by the Game's own tools and are under the MIT License like the code. The fonts are under the SIL Open Font License.
  • The MIT License does not cover the Game's artwork, panda characters and their names, logos, store images and other images (except the interface icons marked as MIT in the source code). These remain the property of the Licensor, as described in the Copyright Notice.

4. Restrictions

Except where the MIT License allows it for the source code, You may not:

  • Copy, distribute, sell, lease or sublicense the Game's artwork, characters, names or logos, or use them in your own games or products.
  • Publish the Game, or a modified copy of it, under the Panda Merge name or with its artwork.
  • Remove, alter or obscure any copyright or other proprietary notices contained in the Game.
  • Sell or trade in-game items or currencies outside the Game.
  • Use bots, scripts, automation tools or exploits to manipulate gameplay, currency generation or purchase systems.
  • Interfere with or disrupt the Game's connection to blockchain networks or third-party services.
  • Change your device's clock or system time to exploit offline earnings, daily rewards or other timed features.

5. Intellectual Property

Apart from the open source parts described in Section 3, all rights, title and interest in and to the Game, including its artwork, character designs, names, logos and other images, are and remain the exclusive property of the Licensor. This license does not transfer any ownership rights to You.

6. Blockchain and Digital Assets

6.1 Wallet Interaction

The Game connects to the Solana blockchain through third-party wallet apps (for example Seed Vault, Phantom, Solflare, Backpack or Jupiter). The Licensor does not have access to, store or control Your private keys or seed phrases.

6.2 Transactions

In-game purchases are token transfers (USDC or SKR) on the Solana blockchain. Blockchain transactions are final, irreversible and publicly recorded on the Solana ledger. The Licensor is not responsible for failed, delayed or misdirected transactions caused by blockchain network issues, wallet malfunctions or user error.

6.3 Holder Perks

The Game gives optional in-game bonuses to holders of a Sensei Panda NFT and of a Seeker Genesis Token, checked by signing a message and looking up the wallet on the blockchain. These bonuses are a feature of the Game only. They do not give any rights in the NFT or token, and the Licensor may change or end them. The Licensor does not mint, sell or manage NFTs or tokens through the Game.

6.4 No Financial Advice

Nothing in the Game is financial, investment or trading advice. You are solely responsible for understanding the risks of cryptocurrency transactions and digital asset ownership.

7. In-App Purchases

  • The Game offers optional in-app purchases, paid in USDC or SKR on the Solana blockchain.
  • All purchases are voluntary. Virtual items and currencies have no real-world monetary value and can only be used in the Game.
  • The Panda Box, and the packs and passes that include Panda Box pandas, give random rewards. The odds are shown in the Game before you buy.
  • The Bamboo Pass unlocks the pass rewards for the current season, which lasts at least 35 days from purchase. Rewards you have earned but not claimed are given when the season ends.
  • Except where the law says otherwise, purchases are final and non-refundable.

8. Advertisements

The Game offers optional rewarded video ads provided by Unity Ads. Ads only play when You choose to watch one, and watching is never required to play. You can choose in Settings whether ads may be personalized. See the Privacy Policy for details.

9. Third-Party Services

The Game relies on the following third-party services, each subject to its own terms:

  • Solana Blockchain - Decentralized network for processing purchases.
  • Solana for Godot (MIT License) - Blockchain integration library.
  • Solana RPC providers (Solana's public RPC or providers such as Helius) - Sending transactions and looking up wallets.
  • Jupiter API - SKR price data.
  • Mobile Wallet Adapter (MWA) - Standard protocol for Android wallet apps.
  • Unity Ads - Rewarded video ads.

The Licensor is not responsible for the availability, accuracy or security of these third-party services.

10. Disclaimer of Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DIGITAL ASSETS, CRYPTOCURRENCY, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE GAME OR BLOCKCHAIN TRANSACTIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Termination

This license is effective until terminated. The Licensor may terminate this license at any time if You breach any terms of this Agreement. Upon termination, You must stop using the Game and delete all copies of it. Termination does not affect blockchain transactions already recorded on the Solana ledger, or Your rights to the source code under the MIT License.

13. Governing Law

This Agreement is governed by the laws of the country where the Licensor is based. If You use the Game as a consumer, You keep the protection of the mandatory consumer laws of the country where You live, and You may bring a dispute before the courts there. Nothing in this Agreement limits rights that the law does not allow to be limited.

14. Changes to This Agreement

The Licensor may change this Agreement at any time. The date of the latest revision is shown at the top of this page. Continued use of the Game after changes are posted means You accept the changed terms.
